RG Childcare – Carer Terms and Conditions

Reward Gateway (UK) Ltd (“RG Childcare”) has arrangements with various clients to issue Childcare Vouchers to their employees who are working parents.

By registering with RG Childcare you agree to accept such Childcare Vouchers in exchange for the provision of childcare services, subject to reimbursement by RG Childcare.

These terms and conditions set out the entire agreement (the “Agreement”) between RG Childcare and you (“the Carer”) to the exclusion of all other terms. No additions to or variations of this Agreement shall have effect unless expressly agreed in writing by RG Childcare. Only RG Childcare and the Carer (and neither the employee recipient of the voucher nor Reward Gateway (UK) Ltd’s clients) may enforce this Agreement.

Neither party will be liable for any breach of these terms and conditions caused by circumstances beyond their reasonable control.

No vouchers will be processed by RG Childcare and no payment made to you unless and until the Web Form has been executed by the parties and a copy of the Carer’s regulatory body certificate has been provided for RG Childcare.

The Carer must provide RG Childcare with a copy of its Regulatory body certificate when returning this Agreement.

The Carer will indemnify RG Childcare from and against all claims, costs, expenses, liabilities, damages or losses incurred or suffered by RG Childcare arising directly or indirectly as a result of or in connection with any act or omission of the Carer or its employees, agents or subcontractors in connection with the provision of childcare services or performance of this Agreement.

Either party may terminate this Agreement immediately if the other becomes insolvent or commits a material breach of this Agreement which in the case of any breach capable of remedy is not remedied within 30 days’ of written notice requiring such remedy. Otherwise, either party wishing to terminate this agreement may at any time give to the other no less than 60 days written notice.

RG Childcare will redeem the vouchers received by the carer subject to compliance by the Carer with these Terms & Conditions.

This Agreement shall be governed in accordance with English law and the English courts shall have exclusive jurisdiction to determine any disputes which may arise out of, under or in connection with this agreement.



The Childcare Voucher Scheme

RG Childcare provides two types of Childcare Vouchers – paper and e-vouchers.

Childcare Vouchers may only be accepted by the Carer in exchange for childcare services. Vouchers must not be exchanged for cash or change is given and any attempt to do so will constitute tax evasion. All vouchers must be presented or redeemed by the person named on the voucher or to whom the e-voucher was credited. The value of a voucher is expressed on the face of the voucher or otherwise indicated on the voucher remittance (or paper voucher remittance) sent to an employee.

The Carer shall not charge the employee presenting the voucher a handling fee for accepting the voucher.

It takes 4 working days to process a voucher payment to a child carer subject to sufficient funds being available.

All instructions to process vouchers received will be entered onto the Carer’s account on the day of receipt or if this is not possible, on the next working day. RG Childcare will then process a BACS to the Carer on the next working day. To be credited as per BACS terms and conditions within three [3] working days. RG Childcare shall not be liable for any failure or delay by BACS to remit payment.

If RG Childcare informs the Carer that certain vouchers are stolen, fraudulent or otherwise invalid, the Carer should not accept such vouchers and RG Childcare will not be liable to the Carer for the redemption of such vouchers.



E-Vouchers

E-vouchers will be redeemed by the employee accessing his/her internet account and arranging payment directly into your bank account. RG Childcare shall have no liability to the Carer for sums owed by the employee for the provision of childcare paid for this way.



Paper Vouchers

When vouchers are received by the carer, the counterfoil must be attached.

The Carer should redeem paper vouchers promptly, (or in any event prior to the printed expiry date), using one of two methods:

  1. By telephone: Carers can submit a telephone remittance by calling 0845 259 3089.
  2. By post: Carers can send the vouchers, with a remittance form, to RG Childcare.

    RG Childcare recommends that all paper vouchers should be sent using recorded delivery or a similar delivery service to : RG Childcare, 44 Broadway, London, E15 1XH.

RG Childcare does not accept liability for vouchers lost in the post or otherwise not received and carers should keep a copy of their counterfoils until payment is received.

All paper vouchers will have an expiry date and must be valid when received by RG Childcare (or received by RG Childcare within 5 working days after the expiry date).

Paper vouchers should not be folded, stapled or defaced in any way as this may delay or void payment.



Your personal details

RG Childcare will process personal data about the Carer in order to administer the scheme, reimburse the Carer for vouchers and as otherwise necessary for the purpose of its business (“Permitted Purposes”). RG Childcare will only process such personal data for the Permitted Purposes and in accordance with applicable data protection laws.

By entering into these Terms and Conditions, the Carer confirms that they have read and understood RG Childcare’s Carer Privacy Notice, which provides further detail about how and why their personal data will be used.

RG Childcare undertakes that it shall not at any time use or disclose to any person any Confidential Information concerning the Carer, except as necessary for the Permitted Purposes or as may be required by law, a court of competent jurisdiction or any governmental or regulatory authority.

Confidential Information means any confidential information relating to the Carer which is disclosed to RG Childcare after the date of this agreement. This includes all confidential or proprietary information relating to the business, affairs, operations, customers and suppliers of the Carer and excludes any information referred to in the paragraph below.

Information which:

  • Is or becomes, generally available to the public other than as a result of the information being disclosed by RG Childcare in breach of these Terms and Conditions.
  • Was, is, or becomes available to RG Childcare on a non-confidential basis from a person who, to RG Childcare's actual knowledge, is not under any confidentiality obligation in respect of that information.
  • Was lawfully in the possession of RG Childcare before the information was disclosed by the Carer.
  • Or, the parties agree in writing is not confidential.
